1. Agreement

By creating an account or using JobPilotX ("the Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and JobPilotX, operated by an individual developer.

2. Service Description

JobPilotX is a SaaS platform that provides:

• AI-powered resume parsing and candidate profile creation using embedding-based matching
• Automated job discovery by scraping public job boards (RemoteOK, WeWorkRemotely, Remotive, Himalayas, Jobicy, EURES)
• AI job-candidate matching and scoring
• AI-generated tailored cover letters and optimized resumes
• Automated job application submission via email and LinkedIn Easy Apply (with your authorization)
• ATS (Applicant Tracking System) compatibility checking for resumes
• Application tracking, follow-up management, and automated email digests (Tuesday and Friday)
• A referral program for earning credits by inviting other users

3. Account Registration and Responsibilities

• You must be at least 16 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must not share your account with others or create multiple accounts
• Notify us immediately at support@jobpilotx.com if you suspect unauthorized access to your account

4. Subscription Plans and Billing

We offer the following subscription plans:

• All payments are processed securely by Stripe
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date
• You may cancel anytime from Settings → Subscription or via the Stripe Customer Portal. Access continues until the end of your current billing period
• We reserve the right to change pricing with at least 30 days written notice. Price changes do not apply to the current billing period
• All prices are in Euros (€) and exclusive of any applicable VAT or local taxes, which may be added at checkout

5. Pay-Per-Apply Credits

• In addition to subscription plans, you may purchase one-time application credits ("pay-per-apply credits")
• Credits are added to your account immediately upon successful payment
• Credits do not expire as long as your account remains active
• Credits are non-refundable once used. Unused credits may be refunded within 14 days of purchase per our Refund Policy
• Credits cannot be transferred between accounts or converted to cash

6. Auto-Apply Disclaimer

By enabling auto-apply or approving individual applications, you expressly authorize JobPilotX to submit job applications on your behalf to employers and job platforms. You acknowledge and agree that:

• Applications are submitted using the information from your profile, resume, and AI-generated cover letters
• JobPilotX is not responsible for the outcome of any application, including rejections, lack of responses, or any consequences resulting from the application
• Some job portals may block or flag automated submissions. We cannot guarantee successful delivery of every application
• You are responsible for reviewing and verifying the accuracy of all information submitted on your behalf
• We implement rate limiting and respectful submission practices, but detection by employer systems remains possible
• Dry-run mode (preview without submitting) is available and recommended for reviewing applications before they are sent

7. LinkedIn Easy Apply Disclaimer

Our Service offers the ability to submit applications through LinkedIn Easy Apply. By using this feature, you acknowledge that:

• Automated interaction with LinkedIn may be in tension with LinkedIn's Terms of Service
• You use this feature at your own risk. JobPilotX is not responsible for any actions LinkedIn may take against your account, including warnings, restrictions, or account suspension
• We recommend using this feature responsibly and within reasonable volume limits
• You may disable LinkedIn Easy Apply at any time from your account settings

8. AI-Generated Content Disclaimer

• Cover letters, tailored resumes, screening question answers, and other written materials are generated by AI models based on your profile data and the target job listing
• AI-generated content may occasionally contain inaccuracies, awkward phrasing, or information that does not perfectly reflect your experience
• You are solely responsible for reviewing all AI-generated content before it is submitted to employers in your name
• We do not guarantee that AI-generated content will result in job offers, interviews, or any particular outcome
• AI match scores are statistical estimates and should be used as one factor among many in your job search decisions

9. Acceptable Use

You agree not to:

• Use the Service to send spam or unsolicited communications to employers
• Create fake profiles, provide false qualifications, or misrepresent your identity
• Use the Service to apply to jobs you are not genuinely interested in or qualified for at a volume intended to harass employers
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Scrape, crawl, or systematically extract data from the Service
• Circumvent rate limits, application quotas, or other technical restrictions through any means
• Use the Service for any illegal, fraudulent, or harmful purpose
• Share, resell, or sublicense your account or access to the Service
• Interfere with or disrupt the Service or its infrastructure

10. Intellectual Property

• Your content: You retain full ownership of your resume, profile data, and any content you upload to the Service
• AI-generated content: Cover letters, tailored resumes, and other AI-generated materials created for you are yours to use without restriction
• Our platform: The Service itself, including its design, code, AI models, algorithms, branding, and documentation, are the intellectual property of JobPilotX and are protected by applicable intellectual property laws
• License to process: By using the Service, you grant us a non-exclusive, worldwide license to process your content as necessary to provide and improve the Service. This license terminates when you delete your account
• Job listings displayed in the Service are sourced from public job boards and belong to their respective publishers

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• We do not guarantee job placement, interviews, callbacks, or any specific employment outcomes
• Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the event giving rise to the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
• We are not responsible for actions taken by employers, job platforms, or other third parties in response to applications submitted through our Service
• We are not liable for service interruptions, downtime, or data loss caused by events beyond our reasonable control

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded or limited under applicable law, including mandatory EU consumer protection rights.

12. Refund Policy

We offer a 14-day money-back guarantee on first subscription purchases, subject to usage limits. Pay-per-apply credits are non-refundable once used. For full details, please see our Refund Policy.

13. Termination

• You may delete your account at any time from Settings → Account
• Upon account deletion, your data will be soft-deleted immediately and permanently hard-deleted after 30 days, in accordance with our Privacy Policy
• We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or third parties
• If we terminate your account for reasons other than a Terms violation, we will provide a pro-rata refund for any unused portion of your current billing period
• Sections 8, 10, 11, 14, and 15 survive termination of these Terms

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the European Union and the member state where the service operator is established. Any disputes arising from these Terms or the use of the Service shall be subject to the jurisdiction of the courts in that member state.

If you are a consumer in the EU, nothing in these Terms affects your mandatory rights under the consumer protection laws of your country of residence. You may bring claims in the courts of your habitual residence.

15. Dispute Resolution

We encourage you to contact us first at support@jobpilotx.com to resolve any issues informally. Most concerns can be resolved quickly through direct communication.

EU consumers may also use the EU Online Dispute Resolution platform to file complaints.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree with the changes, you may cancel your account before they take effect.
